The Dispute Service has published its first Annual Report on Lease Disputes and Resolutions to communicate ideas from 2020-21 to the Private Rental Sector (PRS) at large.
The full report, free to download, is based on data from the 2020/21 period and reveals the leading causes of deposit disputes at the end of leases.
The Dispute Service operates several legal rental deposit protection schemes in England, Wales, Scotland, and Northern Ireland. As part of the overall service, agents, landlords, and tenants have access to free dispute resolution regarding disputes over deposit distribution at the end of the lease.
It also offers free mediation and conciliation services through TDS Resolution in England and Wales and SDS Resolution in Scotland. These operations focus on tenant-tenant disputes that arise during a lease and are intended to help landlords and tenants find a suitable solution that allows them to maintain their leases.

The easy-to-read post presents findings on who initiates the most disputes, the common reasons, and how they are resolved.
Many in the industry will be eager to see who the deposit has been awarded to in dispute cases. The data is broken down by jurisdiction and lease deposit scheme (TDS Insured, TDS Custodial, SafeDeposits Scotland, and TDS Northern Ireland) and shows how often the tenant and landlord win a case come as a surprise to some in the PRS.
For example, in England and Wales, 69 percent of the disputed deposit is split between the landlord and the tenant. The tenant recovers the entire disputed deposit in 16 percent of all disputes. In Scotland, the equivalent figures are 65 percent shared, and in 21 percent of cases, the tenant recovers 100 percent of the disputed award. In Northern Ireland, data shows that the tenant recovers the deposit in 39 percent of all disputes, and 49 percent of disputes have a shared outcome.
Steve Harriott, Executive Director of Dispute Service, said: “We receive about 22,500 initial dispute requests each year at The Dispute Service, and many of them are resolved by landlords and tenants themselves or by our own early resolution efforts. We issue around 15,500 formal awards each year. It’s interesting to see the data on these disputes and share it with the industry to help them avoid common disagreements in the future.”
