Evictions are not allowed until January 2021
The new lockdown would prevent landlords from evicting their tenants.
The evictions will not be carried out until at least January 11, 2021. Meanwhile, there will be no legal action, the government announced.
The six-month notice periods will remain in effect until at least the end of March 2021.
The exception to this rule will be the most severe cases, even when the tenants have demonstrated antisocial behavior or are domestic abuse perpetrators in social housing.
“We have taken the necessary measures to protect the tenants.”
Robert Jenrick, Housing Secretary, said: “We have already taken unprecedented steps to help tenants during the pandemic, including introducing a six-month notice period and financial support to help those struggling to pay rent.”
“Now we go further by protecting tenants from eviction during the new national restrictions and during the Christmas period, with a pause in sheriff’s activity other than in the most serious circumstances, such as antisocial behavior or fraud.”
“Striking the right balance between helping tenants in need and ensuring that landlords have access to justice in the most serious cases.”
The courts will remain open during the second closing.
“The landlords will be the most affected by this decision.”
Timothy Douglas, Director of Policy and Campaigns at ARLA Propertymark, said: “The UK government has once again extended the ban on evictions in England and this will be a further blow to our members.”
“It will cause further distress for landlords who are currently dealing with ongoing rental arrears and will add more pressure on the courts to handle backlogs.”
“Let agents and the entire private rental sector have been affected as a result of Covid-19, and the UK government must acknowledge that this is financially affecting both landlords and tenants.”
“There needs to be a coordinated approach that better supports the needs of the industry, and measures are put in place to further support tenants who have accumulated COVID-related arrears through no fault of their own.”
Since the ban on evictions was announced, many landlords have questioned the UK government’s decision; for them, it is a unilateral decision that only benefits tenants. The landlords cry out for fairer policies for both parties and a definitive solution to this problem.
Since the eviction ban was implemented, landlords across the UK have lost around £ 5 billion in uncollected rent.
It is expected that in the first quarter of 2021, all special measures related to the Coronavirus will be lifted. This will also include the different schemes that the UK government launched to protect the population from the terrible economic impact caused by the pandemic.
