Eviction notice period extends for six months
This is expected to be the last extension given by the UK government.
Landlords in England must now give tenants six months’ notice to apply for possession through the courts, instead of three.
This will apply to all notices delivered to private and social leases from August 29 through March 2021, including Section 21.
However, there are some exceptions, as landlords can give a four-week notice to seek possession in cases of antisocial behavior.
“This extension will help tenants.”
Simon Davis, President of the Law Society of England and Wales, said: “This extension of the notice period will bring relief to tenants facing eviction and give vulnerable tenants the time they need to seek help and find a new place to live.”
“These changes come after the government extended the suspension of evictions for four more weeks, which now end on September 20, and changes to court rules to manage court delays and prevent an increase in homelessness.”
“The extension of the suspension means that the courts can continue to make the necessary arrangements to handle cases safely during COVID-19.”
“The government and the courts also passed new court rules and provided additional protections for vulnerable tenants and those who have been significantly affected by the pandemic.”
“However, more needs to be done, including resolving the legal aid deserts that currently prevent tenants in some areas from receiving legal advice and making broader legislative changes to prevent an increase in homelessness.”
The UK government continues to study more extensions.
Future extensions of the eviction notice period and other financial aid schemes will be a decision to be made by the UK government. Although Rishi Sunak has said that they will do everything possible so that the schemes do not affect the quality of life of the British, the truth is that this does not seem entirely possible.
Landlords are the most at risk because if their tenants cannot pay their rents, they cannot evict them. Three extensions have already been made, and a fourth could be fatal to the UK rental market, landlords would be on the verge of losing their main income.
The decision will rest with the government of Boris Johnson.
